General conditions

Terms and conditions - January '23

Article 1. Applicability

These general terms and conditions apply to all written and oral agreements concerning the services of Katja Wognum.

Article 2. Definitions

In these general terms and conditions, the following definitions shall apply:

1. Contractor: Meditation Coach Katja Wognum, registered in the trade register under number: 34242969, who uses these terms and conditions to offer her services.
2. Client: the person or body who commissions the contractor to perform services.
3. Client: the person who uses any of the services offered by the contractor.
4. Client and client may be the same person, but they do not have to be.

Article 3. Performance of services by contractor

The Contractor shall perform the services to the best of his knowledge and ability. The Contractor has an obligation of effort towards the Client and therefore cannot be held to an obligation of result.

Article 4. Prices and terms of payment

1. Payment for a coaching program, retreat, or meditation course must be made at the time of registration for the service. For other services, payment is due within 14 days of the invoice date.
2. If the client has not paid the amount due within 14 days of the invoice date, the client will receive a payment reminder. If payment has not been made 14 days after this reminder, the contractor is entitled to take collection measures. All costs involved will be borne by the client.
3. If the client has not paid the invoice within the payment period, the contractor shall be entitled to suspend further performance of the service until the payment obligation has been fulfilled.

Article 5. Guarantee in the coaching process

The coaching process and associated training will commence after full payment of the invoice, unless otherwise agreed. If the client is not satisfied after the first coaching session and the first module of the online training, the trajectory can be cancelled. The amount paid will be returned by the contractor minus € 50 administration fee. 

Article 6. Cancellations

Contractor may cancel a service, or refuse a client, without giving a reason.

Client may reschedule a scheduled coaching session 24 hours in advance without charge. If canceling or rescheduling within 24 hours before the session begins, the client will owe the agreed upon price for the session.

Any cancellation will only be based on the guarantee scheme as described in article 5. If the course is not cancelled within 1 day after the first session, the client is not entitled to a refund of the payment.

For other services, the orally or in writing agreed cancellation policy applies.

Article 7. Secrecy

Both parties are obligated to maintain confidentiality of anything discussed during, or in connection with, their agreement.

Article 8. Liability

1. The contractor accepts no liability to the client arising out of any breach or tort attributable to the contractor.
2. If the contractor should be liable for any damages, the liability shall not exceed the amount of the total fee for the service provided.
3. The limitations of liability contained in this article shall not apply if the damage is due to intent or gross negligence of the contractor.
4. If damage is caused to persons or property by or in connection with the performance of services by the contractor, or otherwise, for which the contractor is liable, such liability shall be limited to the amount of the payment made under the liability insurance policy taken out by the contractor, including the deductible borne by the contractor in connection with such insurance.

Article 9. Force Majeure

The Contractor shall be entitled to invoke force majeure if circumstances prevent further performance of the agreed service.

During the force majeure, the obligations of the contractor shall be suspended. If the contractor cannot provide the agreed service for more than 2 months, both parties are authorized to dissolve the agreement, without any obligation to pay damages.

Article 10. Right of application

In the event of any disputes between the client and the contractor, Dutch law shall apply at all times.
